Madras HC Orders Fresh Investigation in Child Sexual Abuse Case

The Madras High Court has ordered a fresh investigation into a case of child sexual abuse after DNA tests cleared the accused of the offense. The Court clarified that the present accused was not exonerated and that his role should also be reassessed during the re-investigation.

The case dates back to 2018 when the accused, employed as a driver, was charged with sexually abusing and kidnapping a 13-year-old girl. The accused allegedly transported the girl to several places, sexually abused her, and filmed the acts before releasing her. The victim, through her father, filed a complaint against the accused on January 2, 2019. The accused was arrested a few days later and subsequently released on bail.

Earlier this year, the accused filed a petition challenging the charge sheet filed by the police, alleging that the evidence was insufficient and that the DNA test results had shown that he was not the father of the child. The High Court ordered the DNA test after the accused alleged that the girl had consensual sex with him.

However, the Madras High Court has now ordered a fresh investigation despite the DNA test results, emphasizing the need for a reassessment of the accused's role. The court expressed dissatisfaction with the investigation and stated that such cases needed to be thoroughly examined.

The High Court's decision highlights the importance of a thorough and fair investigation in child sexual abuse cases, where the accused may use various tactics to evade justice. The case will now be re-investigated, and the role of the accused reassessed, ensuring that justice is served for the victim.
