SC scrutinizes anti-defection law, calls for stronger legislative safeguards

Our democracy needs protecting, and the law provides that protection. Unfortunately, the law also empowers those in positions of authority to be that protector or become a silent observer the latter of which can severely threaten our democratic values. The Supreme Court has recently brought the anti-defection law under scrutiny and calls for legislative reform to strengthen democracy.

A three-judge bench headed by Chief Justice B.R. Gavai recently expressed dissatisfaction with the inaction of the Maharashtra Speaker in dealing with the disqualification of 18 MLAs of the BJP who defected to the BRS. The top court called for reforms to the anti-defection law and the legislators' disqualification process, emphasizing the need for a "strong and effective" mechanism to ensure the law's implementation.

The Court expressed concern over the Speaker's inaction in handling the disqualification and revocation of the MLAs' memberships, despite the Supreme Court's prior ruling. Moreover, the court questioned under what basis the Speaker appointed an administrator to oversee the conduct of by-elections in these 18 seats. This incident raises questions about the functionality and necessity of having a speaker or authority figure in such positions. The court deemed the anti-defection law's current framework as "loose" and called for a "strong mechanism, perhaps even a time frame" to be included in the law for such matters to be dealt with promptly and effectively.

These comments by the Supreme Court bring the anti-defection law back under lens and pave the way for much-needed legislative reform to safeguard the democratic system and uphold the rule of law.
