A new immigration rule to take effect from August 15, 2025, could jeopardize green card prospects for thousands of children of H-1B visa holders, most of whom are Indians. The DHS stated that the tweak to the hold on green cards initiative would exclude from the freeze children whose parents have H-1B visas, which are widely used by Indian information technology professionals. However, it remains unclear whether the move will help or hurt the majority of the affected population.

For years, complaints have been lodged against US President Trump for his immigration policies, which many see as discriminatory against Indians and Chinese, not to mention a violation of human rights. While this new development could benefit those with H-1B visa children, it also could incentivize further discrimination in the already stressful and complex US immigration system.

According to the Department of Homeland Security (DHS), the original intent of the hold on green cards initiative was to stop the disproportionate influx of Indians and Chinese on employment-based green cards, but that the policy had unintended consequences. Children of H-1B visa holders were inexplicably swept up in the freeze, leading to countless personal and professional hardships for young people trying to build lives for themselves in the US.

Many see this policy tweak as a small victory for immigrants in the US, but the larger systemic issues of xenophobia and discrimination in US immigration policy remain.
