The Supreme Court of India has refused to set aside its verdict that imposed deadlines on the President and Governors when they return a bill to the state legislature asking for changes.
The Presidential Reference was filed challenging the court's verdict and the role of the Governor in advising the President in such cases.
A five-judge Constitution bench headed by Justice K.M. Joseph said the court's 2018 verdict making it mandatory for the President to consider the recommendations of the Governor while returning a bill was only "advisory" in nature.
Justice Joseph said the Governor is not bound to give reasons for his advice and the President is not bound to disclose the advice tendered by the Governor, according to Bar and Bench.
The court further added that there is no provision in the Constitution that requires the Governor to act in accordance with the advice of the Council of Ministers in returning a bill.
The bench, also comprising Justices Ajay Rastogi, Aniruddha Bose, Krishna Murthi, and Hima Kohli, posted the matter for further hearing on a later date.
