US Senators Push to End Auto-Renewal of Work Permits, Propose 180-Day Limit

Two influential Republican Senators, John Kennedy and Rick Scott, have introduced a resolution aimed at reversing a Biden-era rule that extended the renewal period for Employment Authorization Documents (EAD) from 180 days to 540 days. The rule, finalized by the Department of Homeland Security on January 13, has been particularly beneficial to the spouses of H-1B visa holders, many of whom are from India, by allowing longer work permit renewals without immediate review.

The change was intended to ease the burden on immigrants, refugees, green card holders, and their families by providing extended work authorization. However, Kennedy and Scott argue that this automatic extension could lead to inefficiencies, potentially allowing work permits to be renewed without sufficient oversight for up to a year and a half.

The resolution, introduced under the Congressional Review Act (CRA) procedures, seeks to disapprove of the rule and return the renewal period to the original 180 days. This move is part of ongoing immigration reform debates, with some lawmakers advocating for stricter controls while others emphasize the need for more flexibility in renewing work permits for immigrants.
