The Additional Sessions Court-III sentenced Hasim, a Loni resident, to a decade of rigorous imprisonment and a substantial fine of Rs 1 lakh under the stringent Narcotic Drugs and Psychotropic Substances (NDPS) Act.
This case, which began on March 2, 2017, when Hasim was arrested with 260 grams of alprazolam, a prohibited substance, has taken a long journey through the legal system. The police filed charges, and the court initiated proceedings on June 22, 2017, with charges framed in October of the same year. Hasim's initial denial of the charges and request for a trial, claiming false implication, led to a prolonged legal process.
The case took a turn when, after seven years in jail, Hasim confessed to the charges, hoping for leniency. However, the defence counsel, Ajit Kumar Handa, argued against this, stating that the confession should not be the sole basis for establishing facts. The prosecution, on the other hand, presented a strong case, with three witnesses testifying to the recovery of the alprazolam powder from Hasim during a routine check.
Judge Sushil Kumar (IV) found the evidence compelling and concluded that the quantity of narcotics fell within the commercial category, mandating a minimum penalty of ten years' imprisonment and a fine of one lakh rupees under the NDPS Act.
