The Allahabad High Court has stayed the suspension of an Assistant Commissioner of Police in Kanpur after he was accused of sexual harassment and extortion. The HC acted upon the policeman's plea who claimed that the disciplinary authority did not give him an opportunity to defend himself before suspending him.

The accused ACP was posted in Kanpur's Captainganj area. He was suspended in August after a woman constable filed a complaint against him. The woman, in her complaint, alleged that the ACP had been harassing her both physically and mentally for over a year. She alleged that he would call her to his home and indulge in sexual gossip frequently. He would also demand that she send him nude photos. The accused would also extort money from her by threatening to ruin her reputation with these photos, the complaint stated.

After the woman's complaint, the ACP was suspended, and a departmental inquiry was initiated against him. The complainant later approached the High Court, stating that the ACP had not been granted an opportunity to defend himself against the allegations.

The plea stated that the complainant was trying to save her skin by dragging the name of an ACP and that the allegations were false. The ACP further claimed that he was not provided with an opportunity to defend himself during a departmental inquiry.

The High Court has stayed the effect of the suspension order until the disciplinary proceedings before the departmental inquiry are concluded. The court said there needs to be an inquiry first to find out whether the allegations are substantiated and a decision taken thereafter.
