India is set to see a surge in mediation cases, as a new 90-day campaign aims to clear the pending cases across the country. The campaign, 'Mediation For Nation' will commence on 1 July and will end on 30 September 2025. The campaign is a collaborative effort from the Ministry of Law & Justice, Government of India, and the Indian Mediation Association.
This campaign aims to increase the efficacy of Alternative Dispute Resolutions (ADR) such as mediation, conciliation, and negotiation.
According to the latest data from the Ministry of Law and Justice, there are over 3.5 crore cases pending across various courts in India. The data also suggests that the recovery of pending cases is increasing at a meagre 0.11% per day.
Speaking to the Times of India, Mr M V Krishnakumar, President of the Indian Mediation Association, part of the campaign, said "The idea is to create massive awareness about the benefits of mediation, and remove the stigma associated with it".
The campaign hopes to achieve the following:
1. To make mediation mainstream and mandatory for settlement of disputes, thereby decreasing the caseload in courts.
2. To popularize and propagate the recently enacted The Mediation Bill, 2021.
3. To help institutions and professionals to develop an efficient, affordable, and effective alternative to litigation.
The campaign will be inaugurated by Minister of Law and Justice, Mr Kiren Rijiju at 6 pm on 1 July 2023 in New Delhi.
This initiative has the potential to reduce the burden on our overburdened courts. With the aim of providing a more expedient and peaceful resolution to disputes, it's hoped that this campaign will encourage more people to explore mediation as a viable option.
