A consumer court in India has fined a hospital $70,000 USD after it left a man permanently blind in one eye and with brain damage.

The incident occurred in 2017 when Suresh Babu, a secretary in the local government, underwent surgery in the Medicover hospital in Tirupati for sinusitis, a common nasal condition. Within 24 hours of the surgery, Babu was suffering from a drooping eyelid and complete vision loss in his left eye. He also developed brain and head complications.

He was transferred to Apollo Brain & Spine Hospitals in the city of Chennai, where he underwent multiple further surgeries.

Babu filed a case against Medicover Hospital for medical negligence. The hospital denied the charges, but the consumer court ruled that the hospital's failure to produce essential medical records and operation notes indicated that the quality of care provided had been inadequate.

The court ordered the hospital to pay Rs.21,62,752.49 in medical expenses, Rs.40,00,000 as compensation for physical and mental suffering, and Rs.5,000 towards case costs. The hospital has been given 45 days to pay the fine, with a 9% annual interest rate on the amount outstanding if it fails to comply with the order.

The case highlights the ongoing issue of medical negligence in India.

In recent years, numerous cases of medical malpractice have led to lawsuits across India.

Last year, a woman gave birth to a baby in a Mumbai hospital without any staff present; the child died shortly after. In 2017, a man in Assam contracted HIV after doctors reused a syringe to administer an anesthetic.

These cases highlight broader problems within the Indian healthcare system, including a lack of accountability and inadequate standards.
