Officials filed a submission detailing the deleted data and opposing Pranjal Khewalkar's bail application.
Police stated in their submission that Khewalkar had used a high-end phone with a SIM card in a friend's name from Muktainagar. Officials added that investigations into the purpose of this were ongoing.
The police had seized the phone and handed it over to cyber experts to extract WhatsApp account data on July 31.
Incriminating data was discovered, but when the experts tried to retrieve the data again on August 6, they found that all the data on the phone had been deleted. The police then secured the call data record of the phone and discovered that the SIM card was in a third person's name. This individual had reported the theft of their phone and secured a new SIM card, which they put in a new cellphone, allowing them to transfer all WhatsApp data and delete the data on the seized phone.
The police concluded that this amounted to the destruction of evidence, and if Khewalkar was granted bail, he might continue to destroy evidence related to the case.
The police argued that Khewalkar and six others should not be granted bail due to the seriousness of the crime of holding an illegal house party involving cocaine, marijuana, hookah pots, and liquor.
