HC sceptical of state's selective action in graft, drug case

Punjab and Haryana High Court flags discrepancies in police probe where accused police official was not charged with corruption, while complainant and her husband were not booked under NDPS Act despite admissions of possessing contraband. The court has referred the case to the Narcotics Control Bureau (NCB) Chandigarh Zonal Unit for further investigation.

A high court has expressed skepticism about the state's selective action in a graft and drug case, questioning how a police official accused of accepting a bribe was not charged with corruption, despite the complainant and her husband not being booked under the NDPS Act despite their admissions of possessing contraband.

The case originated from a woman's complaint alleging that a petitioner-police official and his team raided her house on December 17, 2020, and recovered 10 kg of ganja. She claimed that the officer demanded Rs 20 lakh to settle the case, ultimately agreeing to Rs 16 lakh.

The high court noted the state's failure to register a criminal case against the police official and the complainant's family, even though it initiated an inquiry against the official. It highlighted the fact that the payment and acceptance of bribes are criminal offenses under the Prevention of Corruption Act, and possessing 10 kg of ganja is a punishable offence under the NDPS Act.

The court was highly critical of the state's response, deeming it appropriate to refer the matter to the Additional Director, NCB, Chandigarh Zonal Unit, for an independent examination of the alleged recovery of 10 kg of ganja and the Rs 13 lakh bribe transaction.

This is a developing story and will be updated as new information becomes available.
